Proving legal liability

To win a personal injury case, you must be able to prove the other party was “liable,” meaning they were at fault in your accident. There are four elements that must be proven for someone to be found liable for personal injury damages:

  • Duty: The defendant must have had a legal duty owed to the plaintiff. Drivers on the road, for example, have a legal duty to other motorists and pedestrians to follow the rules of the road and drive as safely as possible.
  • Breached duty: You must then be able to prove that the defendant failed to live up to their duty. Again, using the car accident example, the driver would breach their duty of care if they were texting behind the wheel, or if they blew a stop sign.
  • Causation: The next step is to prove the defendant’s breach of duty caused the accident directly.
  • Damages: This is the simplest portion to prove. You must show there was some damage caused to you. Examples include medical bills, injuries, lost income, psychological damage and more.
